Community Associations
Community association law is a unique and complex specialty within real estate law. Homeowners’ associations, condominium associations, and cooperative associations can face legal issues that involve enforcing compliance with statutory mandates and governing documents, compliance with fair housing laws, debt collection, local code and regulatory compliance, proper recordkeeping, and financial mismanagement. A community association’s board of directors must have a professional, knowledgeable, and experienced team of advisors to ensure the efficient, financially responsible, and legal compliant operation of the community association. As fractional legal counsel to small and large community associations, self-managed and with property managers (also called “community association managers”), we advise and represent community associations in matters involving:

Board governance, duties and obligations

Interpretation and amendment of governing documents, e.g., declarations, bylaws, rules, resolutions, etc.

Assessment collection and lien enforcement

Covenant enforcement

Architectural control and use restriction compliance

Negotiation and review of construction contracts

Vendor, management, service contracts

Insurance, property damage

Fair housing, including reasonable accommodation, reasonable modification, and harassment

Meeting procedures, elections, recordkeeping, and records requests

Dispute avoidance, negotiation, mediation, and litigation

Board member education
Effective legal counsel not only timely and appropriately responds after an issue arises, but also proactively assists boards of directors in governing with knowledge and confidence, developing legally sound policies and procedures, making informed decisions, and reducing or eliminating avoidable risk before it results in a lawsuit or claim against the community association. We provide board member education for community associations we do not represent as well.
